Conditions of Entry and Sale Camberwell Online Gallery Best of Boroondara Exhibition

Important Dates:

  • Uploading date for exhibition artworks: 7th October to 27th October
  • Cut Off Date for Payment of Exhibition Fee: 27th October
  • Applicable Fees: $5 per painting exhibition fee
  • Percentage Commission levied on Sales 25%


In submitting an Exhibit, the Artist contracts with the Rotary Club of Camberwell Inc. [hereinafter referred to as ‘the Club’] and acknowledge acceptance of the following conditions of entry:

1.0 Exhibition Terms:

1.1 All entrants must reside in or have a studio within the City of Boroondara   

1.2 All exhibits must be “Artwork” defined as NEW ORIGINAL PAINTING OF THE EXHIBITOR. Original work excludes reproductions, or any works worked on by a tutor.  If a person other than the Artist makes an entry on behalf of the Artist, a written authority signed by the Artist authorising that person must be emailed to:

1.3   All entries must be made through and click on “Best of Boroondara Entry” button at the bottom left of front page

1.5 The artist shall not:

  • Submit an Artwork, if the sale of the Artwork is a resale within the meaning of the Resale Royalty Right for Visual Artists 2009;   
  • Submit an Artwork if, the sale of the artwork is buying, selling, exchanging or otherwise dealing in second-hand goods within the meaning of the Second-hand Pawnbrokers Act 1989;
  • Lodge any registration under the Personal Property Securities Act 2009 (PPS); or
  • Submit an Artwork that is in anyway charged or encumbered to a third party or has a registration under the PPS.

1.6 All Artwork submitted will be for sale.

1.7 The Artist will fix the sale price (inclusive of Commission) on the exhibition form.

1.8 Exhibition fees are not refundable under any circumstances even if the Artwork[s] are not received by the Club by the due date of uploading to the Online Gallery.

1.9 The Artist appoints the Club as his or her agent for the purposes associated with the exhibition and authorises its sale and grants a licence to the Club to reproduce any Artwork submitted for the purpose of publicity, promoting the exhibition, education, including artworks in an on-line catalogue/social media promotion.

2.0 Restrictions on Artworks Being Entered:

2.1 Number of Artworks:   The Artist shall enter up to five [5] Artworks (unless otherwise advised) and warrants that all exhibits submitted are his or her original uncopied work.

2.2 Size of Artwork:   there is no limit on the size of an exhibited artwork.

2.3 Framing: All framed artwork to be framed to a professional standard.   Stretchered canvas is considered framed but must have rigid and adequate cross members.  Each framed Artwork must be fitted with substantial hanging wire or cord and ‘flush D hangers.’ The apex of the hanging wire should be approximately 75mm. below the top of the frame.   

Unframed artwork to be of a professional standard in presentation and quality of support.

2.4 Non Acceptable Artworks: Artworks of a 3D nature, beaten metal, painted porcelain, ceramic, photographs, digitally enhanced artwork, computer generated works, ‘worked’ prints, prints including linocuts, monoprints, stencils, etchings, pokerwork, pyrography, textile art works, bark arrangements, plaster relief Artwork, unprotected tempera or wet artworks or Artworks of a like nature of the above [as determined by the Club in its absolute discretion], are not acceptable.

The committee will NOT accept an example of the above described Artwork.

3.0 Submission Process:

3.1 Each image uploaded in the “Best of Boroondara” Exhibition must be a high-resolution jpeg file. There will be an opportunity to include both the framed and unframed dimensions and price of each artwork for those buyers who may prefer the artwork unframed.

3.2 If the image is not of a suitable hi-res quality for online display it will not be selected. See “Resource for Artists – How to Photograph your Artwork” provided by the City of Boroondara.

3.3 All exhibited Artwork must be made available for sale and if sold must be delivered to the purchaser by the artist.

3.4 If the artwork is sold and there is a significant or noticeable difference between the uploaded image and the actual Artwork on delivery to the purchaser, the Club reserves the right to reject the sale. Any sale will not be paid to the artist until he/she has delivered it to the purchaser’s satisfaction. If the artwork is subsequently rejected by the purchaser the payment for the sale will not be transferred to the artist’s bank account.

3.5 An Artist must provide bank account details to enable payment to be made to the Artist for any Artwork sold during the exhibition.

3.6 After the exhibition has finished, each unsold Artwork will be included in the CAS Online Gallery in the dropdown tab titled “Previous Exhibitions” until it is sold. Artists must notify the Club if any exhibited Artwork is no longer available for sale.

4.0 Commission and GST:

4.1 The Club is authorised to offer any exhibit for sale to the public at the price [inclusive of GST, if any] endorsed on the electronic exhibition form and in the event of the sale being affected, to retain twenty five per-centum [25%] of such price as a selling commission. The commission includes GST.

4.2 GST has been included in all fees and charges. Artists must complete the GST Section by selecting one of the five [5] categories and provide relevant information.

4.3 Artists are liable for all or any GST on exhibition fees.

4.4 The Club reserves the right to reject an exhibit where insufficient GST information is given.

5.0 Delivery of Sold Artworks:

5.1 If the buyer resides within the Melbourne Metro area, the artist is responsible for the safe delivery of the

sold painting to the central depot at 30 Pine Avenue Camberwell. The buyer will then collect the painting from the depot.

5.2 If the buyer resides outside the Melbourne Metro area the delivery of the sold painting is to be negotiated between the artist and the buyer.

6.0 Insurance:

6.1 Artists are responsible for insuring their sold Artwork against loss or damage while in transit to the purchaser.

7.0 Payments to Artists:

7.1 The artist is required to provide accurate Bank Account details and the Club will pay by EFT to the Artist the sale proceeds less commission [inclusive of GST] within ten [10] business days of the transfer of payment to the Club’s bank account.  

8.0 General:

8.1 These Terms and Conditions cannot be varied unless agreed in writing by the Club. The Club reserves the        right to vary the dates either generally or for any particular Artwork.
